Article 33. (1) When the goods do not meet the individual requirements for compliance with the contract, the objective requirements for compliance, and the requirements for the installation or setup of the goods, the consumer has the right: 1. to make a complaint, requesting the seller to bring the goods into compliance; 2. to receive a proportional reduction in price; 3. to terminate the contract. (2) In the cases under paragraph 1, item 1, the consumer may choose between repair or replacement of the goods, unless this proves impossible or would result in disproportionately high costs for the seller, taking into account all circumstances of the specific case, including: 1. the value that the goods would have if there were no lack of compliance; 2. the significance of the non-compliance, and 3. the possibility of providing the other means of consumer protection without significant inconvenience to the consumer. (3) The seller may refuse to bring the goods into compliance if repair and replacement are impossible or would result in disproportionately high costs for him, taking into account all circumstances, including those under paragraph 2, items 1 and 2. (4) The consumer has the right to a proportional reduction in price or to terminate the sales contract in the following cases: 1. the seller has not carried out the repair or replacement of the goods according to Articles 34, paragraphs 1 and 2 or, where applicable, has not carried out repair or replacement according to Articles 34, paragraphs 3 and 4 or the seller has refused to bring the goods into compliance according to paragraph 3; 2. a non-compliance arises despite the seller's actions to bring the goods into compliance; in the case of non-compliance of durable goods and goods containing digital elements, the seller has the right to make a second attempt to bring the goods into compliance within the warranty period under Article 31; 3. the non-compliance is so serious that it justifies an immediate reduction in price or termination of the sales contract, or 4. the seller has stated or it is clear from the circumstances that the seller will not bring the goods into compliance within a reasonable time or without significant inconvenience to the consumer. (5) The consumer does not have the right to terminate the contract if the non-compliance is minor. The burden of proof for whether the non-compliance is minor rests with the seller. (6) The consumer has the right to refuse payment of the remaining part of the price or part of the price until the seller fulfills his obligations to bring the goods into compliance.
Article 34. (1) The repair or replacement of the goods is carried out free of charge within a reasonable time from the notification of the seller by the consumer about the non-compliance and without significant inconvenience to the consumer, taking into account the nature of the goods and the purpose for which they were necessary for the consumer. (2) For goods other than goods containing digital elements, the repair or replacement of the goods is carried out free of charge within one month from the notification of the seller by the consumer about the non-compliance and without significant inconvenience to the consumer, taking into account the nature of the goods and the purpose for which they were necessary for the consumer. (3) When the non-compliance is remedied by repair or replacement of the goods, the consumer makes the goods available to the seller. Upon replacement of the goods, the seller takes back the replaced goods from the consumer at his own expense. (4) When carrying out repairs requires the disassembly of goods that have been installed according to their nature and purpose before the non-compliance arose, or when these goods need to be replaced, the seller's obligation to repair or replace the goods includes disassembly of the non-compliant goods and installation of the replacement goods or repaired goods, or covering the costs of disassembly and installation of the goods. (5) The consumer does not owe payment for the usual use of the replaced goods for the time before their replacement.
Article 35. The reduction in price is proportional to the difference between the value of the goods received by the consumer and the value that the goods would have had if there were no lack of compliance.
Article 36. (1) The consumer exercises the right to terminate the contract by submitting a statement to the seller, notifying him of his decision to terminate the sales contract. (2) When the non-compliance relates only to some of the goods delivered under the sales contract, and there is a basis for termination of the contract under Article 33, the consumer has the right to terminate the sales contract only regarding those goods that do not comply, as well as regarding all other goods acquired together with the goods that do not comply, if it cannot reasonably be expected that the consumer will agree to keep only the goods that comply. (3) When the consumer terminates the sales contract wholly or partially only regarding some of the goods delivered under the sales contract, the consumer returns these goods to the seller without undue delay and no later than 14 days from the date on which the consumer has notified the seller of his decision to terminate the sales contract. The deadline is considered met if the consumer has returned or sent the goods back to the seller before the expiration of the 14-day period. All costs for returning the goods, including shipping of the goods, are borne by the seller. (4) The seller refunds the consumer the price paid for the goods after their receipt or upon presentation of evidence from the consumer for their dispatch to the seller. The seller is obliged to refund the amounts received, using the same payment method used by the consumer in the initial transaction, unless the consumer has expressly agreed to use another payment method and provided that this does not incur costs for the consumer.
Article 37. (1) The consumer may exercise his rights under this section as follows: 1. for goods other than goods containing digital elements, within two years from the delivery of the goods; 2. for goods containing digital elements, when the sales contract provides for a one-time provision of digital content or a digital service, regardless of whether the non-compliance is due to the physical or digital elements of the goods, within two years from the delivery of the goods and the provision of digital content or digital service or within the time period specified in Article 31, paragraphs 1 and 2, without prejudice to the application of Article 28, paragraph 3, item 1; 3. for goods containing digital elements, when the sales contract provides for continuous provision of digital content or a digital service for a specified period, regardless of whether the non-compliance is due to the physical or digital elements of the goods, within two years from the delivery of the goods and from the start of the continuous provision of digital content or digital service; 4. for goods containing digital elements, when the sales contract provides for continuous provision of digital content or a digital service for a period longer than two years, and the non-compliance is due to the digital elements of the goods, the consumer may exercise his rights under this section within the term of the contract. (2) The period under paragraph 1 ceases to run during the time necessary for the repair or replacement of the goods. (3) The exercise of the consumer's right under paragraph 1 is not subject to other deadlines for filing a claim, other than those under paragraph 1.
Article 38. The seller, who is responsible for the non-compliance of the goods due to action or inaction, including failure to provide updates for goods containing digital elements, by a person at a previous stage of the chain of commercial transactions, has the right to a claim for compensation for damages against the person or persons who caused the non-compliance.
Commercial Warranty of Goods
Article 39. (1) The commercial warranty binds the provider in accordance with the terms specified in the application for the provision of a commercial warranty or in the related advertisement available before or at the time of the conclusion of the contract. (2) When a manufacturer provides a consumer with a commercial warranty for the durability of certain goods for a specified period, the manufacturer is directly liable to the consumer for the entire duration of the commercial warranty for the durability of the goods regarding the repair or replacement of the goods, in accordance with Article 34. The manufacturer may offer the consumer more favorable conditions in the application for the provision of a commercial warranty for durability. (3) When the terms specified in the application for the provision of a commercial warranty are less favorable for the consumer compared to those in the related advertisement, the commercial warranty is mandatory for the person providing it, in accordance with the terms provided in the advertisement regarding the commercial warranty, except in cases where, prior to the conclusion of the contract, the advertisement for the commercial warranty has been corrected in the same manner as it was made, or in a similar manner.
